PERTANGGUNGJAWABAN TINDAK PIDANA TERHADAP PELAKU PEMALSUAN OBAT

Abstract

Circulation of counterfeit drugs is rife in various countries including Indonesia. The circulation of thseedrugs is vert worrying because it can threaten public health. Based on empirical evidence revealed varioussources, the most widely circulated fake drugs are : painkillers and antibiotics. These drugs are circulating inthe community without government permission and laboratory test. It cannot be ascertained what content iscontained in the fake or illegal drugs . The problem is how to regulate the crime of drug counterfeitingaccording to law number 36 of 2009 concerning Health and according Indonesian Criminal Code.The research method is juridical empirical and descriptive analytic.The result of this research is that the regulation regarding the criminal act of drug counterfeiting in Indonesia isregulated in several statutory provisions , namely Indonesian Criminal Code, law number 36 of 2009concerning Health and Law number 8 of 1999 concerning Consumer Protection.Keywords : fake drugs, criminal action, criminal liablity
